Ball'N Terms of Use

1.1 Minimum Age. You must be at least 9 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service and that your parent or legal guardian agrees to these Terms on your behalf.

1.2 Location. The Service is designed for users located in the United States. If you access the Service from other locations, you do so on your own initiative and are responsible for compliance with applicable local laws.

1.3 Authority. If you use the Service on behalf of an entity, you represent that you are authorized to accept these Terms on that entity’s behalf.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. In some cases, we may provide additional notice (such as posting a notice within the Service or sending you an email, where appropriate).

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

3.1 Overview. Ball’N is a casual game. Users can log in daily to play a new puzzle. Each puzzle is available for a limited time (for example, a single day), and players receive a score based on factors such as how long they take to solve the puzzle.

3.2 No Prizes or Monetary Rewards. The Service is offered for entertainment purposes only. Ball’N does not offer any cash prizes, gift cards, or other tangible rewards or incentives for playing or achieving particular scores. Any points, scores, rankings, or similar metrics displayed in the Service:

• Are virtual indicators only;
• Have no real-world monetary value;
• Are not redeemable for money, goods, or services; and
• May be modified or reset by us at any time at our sole discretion.

3.3 Modifications and Availability. We reserve the right to change, suspend, or discontinue any part of the Service (including puzzles, features, or availability) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3.4 No Guarantee of Accuracy. While we strive to create accurate, fair, and functional puzzles, we do not guarantee that any particular puzzle, score, or result is error-free. Occasional errors, ambiguities, or technical issues may occur.

4.1 Registration. To use certain features of the Service, you may be required to create an account or log in using a third-party sign-in (such as Apple, Google, or similar services, if offered). When you create an account, you agree to provide accurate, current, and complete information.

4.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly at contact.ballnpuzzles@gmail.com if you suspect any unauthorized use of your account or any breach of security.

4.3 One Account Per Person. We reserve the right to limit each user to a single account and to take appropriate action (including suspension or termination) if we detect multiple accounts for the same individual in a manner that undermines the integrity of the game.

You agree that you will use the Service only for lawful purposes and in accordance with these Terms. You may not, and you agree not to attempt to:

• Cheat or tamper with gameplay, including by using bots, scripts, automated tools, or any other methods designed to manipulate scores, puzzle results, or access;
• Disrupt or interfere with the Service, servers, or networks connected to the Service;
• Reverse engineer, decompile, or disassemble any portion of the Service, or attempt to derive the source code or underlying ideas or algorithms;
• Bypass or circumvent security features, including any access or usage restrictions;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Service in a manner that violates any applicable law or regulation; or
• Use the Service for any commercial purpose without our prior written consent.

We may investigate and take any appropriate action in response to violations of this Section, including suspending or terminating accounts and cooperating with law enforcement authorities where required.

6.1 Usernames and Profiles. The Service may allow you to create a username and limited profile (for example, a display name, avatar, and basic settings). You are responsible for your chosen username and any profile information you provide.

6.2 Content Restrictions. You agree that your username, avatar, or any other limited content or communications you submit through the Service will not:

• Be unlawful, defamatory, harassing, hateful, discriminatory, or otherwise offensive;
• Infringe any copyright, trademark, privacy, publicity, or other rights of any person or entity; or
• Contain spam, advertising, or other commercial solicitations.

6.3 License to Ball’N. To the extent the Service allows you to input or submit any content, you grant Ball’N a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, and otherwise exploit such content in connection with operating and improving the Service. You understand that this license continues as long as we reasonably need it for the purposes described, subject to applicable law.

6.4 Monitoring and Removal. We reserve the right, but are not obligated, to monitor, review, or remove any content or usernames, at our sole discretion, if we believe they may violate these Terms or any applicable law.

7.1 Ownership of the Service. The Service, including all puzzles, game logic, software, code, text, graphics, logos, icons, characters, illustrations, animations, audio, and other materials provided by or on behalf of Ball’N (collectively, the “Ball’N Content”), is owned by Ball’N or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License to You. Subject to your compliance with these Terms, Ball’N grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial entertainment.

7.3 Restrictions. Except as expressly permitted in these Terms, you may not:

• Copy, modify, distribute, sell, lease, or create derivative works based on the Service or any Ball’N Content;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices; or
• Use any Ball’N trademarks, logos, or brand elements without our prior written permission.

7.4 Feedback. If you choose to provide suggestions, feedback, or ideas about the Service (“Feedback”), you acknowledge that Ball’N may use that Feedback in any manner, without restriction, and without any obligation to compensate you.

8.1 Third-Party Services. The Service may integrate or interact with third-party services (such as sign-in services, analytics tools, or app store platforms). Your use of any third-party services is subject to the terms and privacy policies of those third parties.

8.2 Links. The Service may contain links to third-party websites or resources. Ball’N is not responsible for the content, products, or services on or available from those websites or resources. You acknowledge that you are solely responsible for and assume all risk arising from your use of any third-party websites or resources.

To the maximum extent permitted by applicable law, Ball’N and its owners, officers, employees, contractors, licensors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or use, arising out of or related to your access to or use of the Service.

You agree to defend, indemnify, and hold harmless Ball’N and its affiliates, owners, officers, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or your violation of these Terms.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if your use of the Service creates risk for Ball’N, other users, or third parties.

These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of California, without regard to conflict of law principles.

These Terms constitute the entire agreement between you and Ball’N regarding the Service and supersede any prior or contemporaneous understandings related to it.

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or of any other provision.
